1. Presentation of the company
EVI is a French company specializing in the manufacture and sale of leather shoes, whose head office is located at 13bis rue Pontcottier, 38300 Bourgoin-Jallieu. The company has a share capital of €4,400 and is registered under SIRET number 92204355900017. (IDU - Refashion: FR384126_11WVON)
2. Products
The products offered are those which appear on the site www.evi-shoes.fr They are put on sale for order and pre-order.
Each product is presented on the site with the greatest possible accuracy. However, if errors or omissions may have occurred regarding this presentation, the liability of SAS EVI could not be engaged. The photos and texts illustrating the products do not enter into the contractual field. SAS EVI could, due to its suppliers, be required to deliver to the customer an item of composition slightly different from that described but in any case of quality equal to or superior to the item ordered.
3. Orders
The customer can place an order on the company's website www.evi-shoes.fr. The order will be considered final after validation of payment by EVI. EVI reserves the right to refuse any order for legitimate reasons.
4. Price
The prices appearing on the site are expressed in euros (€) and all taxes included (TTC), taking into account the value added tax (VAT) applicable on the day of the order. EVI reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the site on the day of the order will be the only one applicable to the customer.
5. Payment
Payment can be made online by bank card (CARTE BLEUE / VISA / MASTER CARD / AMERICAN EXPRESS / APPLE PAY) The order will be validated after confirmation of payment by the company EVI.
6. Delivery
EVI undertakes to ship the products within an average of 48 to 72 hours after validation of the order. In the case of a pre-order, the delivery time is indicated on the description sheet of each product. Shipping costs are free for all deliveries in metropolitan France with the carriers chosen by EVI (such as UPS, Chronopost, Colissimo, etc.). The customer will be informed by email of the shipment of the order and its tracking number.
7. Pre-order
The customer may place a pre-order for products that are announced as being on pre-order on the website www.evi-shoes.fr. Pre-orders are subject to these General Terms and Conditions.
The start and end date of the pre-order period is specified on the evi-shoes.fr website. The customer will be informed of the estimated delivery date when pre-ordering via the product sheet. The delivery time may vary depending on the end date of the pre-order period and product availability.
8. Gift cards
Conditions of use for virtual gift cards :
Virtual gift cards issued by EVI are sent by email to the address provided at the time of purchase and can only be used on the website www.evi-shoes.fr . Virtual gift cards cannot be used to purchase other gift cards and are neither refundable nor exchangeable for cash.
Validity of virtual gift cards :
Virtual gift cards are valid for 12 months from the date of purchase, unless otherwise stated. After this period, they can no longer be used, and no refunds will be made.
Use and safety :
The buyer is responsible for the accuracy of the information provided when purchasing a virtual gift card, including the recipient's email address. In the event of loss, unauthorized access or fraudulent use of a virtual gift card, EVI will not be held responsible once the card has been sent to the specified email address.
Fraud and misuse :
Any attempt at fraud, misuse or illegal use of a virtual gift card will result in the cancellation of the card and associated orders, with no possibility of refund. EVI reserves the right to block any virtual gift card or order in the event of suspected fraudulent or illegal activity.
Complaints and chargebacks :
In the event of a dispute related to the purchase of a virtual gift card, the buyer must contact SAS EVI directly. Virtual gift cards, once activated and used, cannot be subject to chargeback or refund after use. In the event of an attempted abusive chargeback, EVI reserves the right to block use of the card and take the necessary measures to recover the funds.
Sending and receiving :
Virtual gift cards are usually sent by email within a few hours after payment validation. In the event of a technical problem causing a delay in sending the virtual gift card, the buyer is invited to contact EVI customer service to resolve the problem.
8. Returns and exchanges
The customer has 15 days from the delivery date to return or exchange a product, provided that it is in perfect condition and in its original packaging. EVI does not provide refunds, but accepts exchanges, except in cases where an exchange is not possible.
9. Liability and warranty
EVI cannot be held responsible for direct or indirect damages, such as loss of data, loss of profits or any other loss, resulting from the use of the website or the products purchased on it.
However, in the event of a lack of conformity of the products delivered, EVI undertakes to replace or reimburse the products concerned, in accordance with the legal provisions in force.
10. Intellectual property
All elements of the EVI-Shoes.fr website, whether visual or audio, are protected by copyright, trademarks or patents. They are the exclusive property of the EVI company. Any total or partial reproduction, modification or use of these elements, without prior authorization from the EVI company, is strictly prohibited and constitutes an infringement.
11. Dispute Resolution
In the event of a dispute between EVI and the customer, the parties undertake to seek an amicable solution.
In the absence of such a solution, the dispute will be submitted to the competent courts in accordance with the rules of common law.
12. Modification of the T&Cs
EVI reserves the right to modify these general conditions of sale at any time. The applicable conditions are those in force on the date of the order.
13. Personal data
EVI is committed to protecting the personal data of its customers and to complying with current legislation regarding the protection of personal data.
The data collected during the order are necessary for processing the order. They are kept for a period strictly necessary for order management and the commercial relationship.
The customer has the right to access, rectify, oppose and delete their personal data, in accordance with current legislation.
